Weapons, Nonlethal

Nonlethal weapons are devices intended to incapacitate personnel while minimizing physical harm to the group or individual with relatively reversible effects. These weapons have been developed independently and in concert with lethal weapons. Some of the devices have unique capabilities that require specific training, while others are simple in design and employment. There are a range of effects that are gained by the employment of nonlethal weapons, ranging from irritating to incapacitating. Additionally, the development of nonlethal weapons has extended to disabling equipment without employing lethal means. While there has been debate over defining nonlethal weapons, there has also been debate over the term nonlethal because nonlethal weapons can have lethal effects. The military has defined nonlethal weapons in Joint Publication 1-02 as follows:

Weapons that are explicitly designed and primarily employed so as to incapacitate personnel or material, while minimizing fatalities, permanent injury to personnel, and undesired damage to property and the environment. a. Unlike conventional lethal weapons that destroy their targets through blast, penetration, and fragmentation, non-lethal weapons employ means other than gross physical destruction to prevent the target from functioning. b. Non-lethal weapons are intended to have one, or both, of the following characteristics: (1) They have relatively reversible effects on personnel or materiel. (2) They affect objects differently within their area of influence.

The development of nonlethal weapons has illuminated the need for policy in this area. As commanders identify the need to employ less lethal weapons, a strategy and ultimately a national policy regarding the use of the weapons are needed. Prior to the end of the Cold War, the enemy was easily identifiable, and engagements with the enemy were more clearly defined. Subsequent to the Cold War, the enemies the United States faced were not always uniformed, and engagements with the enemy were defined not by victory but by measures of success or stability. The employment of lethal weapons does not always result in stability—thus the need for a less lethal option.

Background

Historically, nonlethal weapons have been developed and employed by military forces, but not on an equitable scale of the post–Cold War era. The dawn of nonlethal weapons came in the 1960s. During this time, an increase in demonstrations and riots was accompanied by pressure for national policies to restrict the use of lethal force. The 1967 report of the President’s Crime Commission on Law Enforcement and the Administration of Justice recommended that research and scientific study be utilized in solving the problems of law enforcement. This gave rise to a commercial industry, albeit small in the beginning, devoted to the research, development, and production of nonlethal weapons. The first reaction was to turn to the military and their capabilities. Irritant chemical weapons, developed by the military, were the most mature and developed technology and, therefore, the most widely adopted. Following this, a technological explosion occurred in the late 1960s and 1970s, which produced an array of weapons that ranged from a variety of irritant gases to kinetic weapons that produced blunt force trauma. Some of the weapons studied produced unacceptable levels of injury, while others were easily defeated. There was a need for balance and the ability to produce scalable effects.
