Peremptory Challenge
A right granted to the defense and prosecution teams during the voir dire to disallow the selection of particular potential jurors on the basis of personal biases that these individuals may have toward the case. Peremptory challenge seeks to create an objective and impartial jury and serves the purpose of ensuring a just and unbiased trial. Because both defense and prosecution teams provide input in the selection of jurors, preemptory challenge also results in a reduced likelihood that either side would view the verdict as biased or unjust. Counsel has a limited number of peremptory challenges and does not have to state the reason for dismissal of the potential juror. The reasons for dismissal cannot be based on gender or race.
