Contributory Negligence
A tort claim, currently known as comparative negligence in most U.S. jurisdictions. It was used as a common-law defense in cases where the defendant was charged with negligence but stated that his or her negligence was in part based on or contributed to by the careless actions of the plaintiff. Remedies or damages are typically reduced, depending on the role the plaintiff played in contributing to the overall negligence.
