A judge can determine a defendant's sentence and then defer that punishment on the condition that the defendant follows the rules of probation while living in the community. Suspended sentences are commonly used in cases involving first time offenders who have committed a minor crime. Should the defendant violate the rules of probation, the original punishment will then be administered (e.g., the jail sentence).
