In Maryland v. King, the U.S. Supreme Court faced yet another issue arising from the collision of rapidly evolving new technologies and traditional constitutional law. Currently, all fifty states require the DNA testing of anyone who is convicted of a felony. This case, instead, addressed whether the government can collect DNA from those who are merely arrested for a serious crime but not yet convicted of that crime.
