Will the Kroger-Albertsons Acquisition Pass Antitrust Scrutiny?

Abstract

In October 2022, grocery giant Kroger announced plans to acquire Albertsons in a USD 24.6 billion deal. If officials approve the deal, it would unite two of the country’s largest grocery chains and could reshape the U.S. supermarket landscape as a whole. But as U.S. antitrust regulators continue to scrutinize acquisitions of this scale (having already blocked the merger between publishers Penguin Random House and Simon & Schuster), it is possible that the marriage between these two major grocers is on shaky ground. This case asks students to examine and discuss the merger.
