Explanation of the Special Education Process

Since education is a state function, state statutes as well as federal law govern the special education process. The state's special education laws must be consistent with federal laws; however, there will be differences between states. Some states have provisions that go beyond what is required by IDEA and may provide students with additional disability rights and protections under state statutes.
