Substantial Disruption in Schools: The Tinker Decision

All discussion on student speech activity must begin by including the relevant principles proclaimed in the seminal Supreme Court case of Tinker v. Des Moines Independent Community School District.1 Mary Beth Tinker and two other students openly violated the Iowa school policy banning armbands in school. The three wore black armbands to protest the Vietnam War and were suspended as punishment. However, the suspension violated the students’ First Amendment right to free speech. In their decision, the Court made the now famous statement, “It can hardly be argued that either students or teachers shed their constitutional rights to freedom of speech or expression at the school house gate.”2
