Proactive Approaches to Cyber Bullying
In addition to the case law precedent for reactive handling of cyber bullying incidents, many states and schools are employing proactive measures to prevent cyber bullying. To that end, many new laws, procedures, and practices have been created and enacted to discourage bullying types of behavior. Some include technological limitations and disablement measures, some include student-parent-school contracts based upon acceptable use policies (AUPs), and some include criminal or criminal-like sanctions for engaging in cyber bullying behavior. Inappropriate expressions may subject students not only to school discipline but also to criminal punishment or civil liability.
Not all forms of cyber bullying are actionable, as case law indicates. Distinguishing free expression from censorable online behavior poses its own issues. ...
