This chapter surveys post-New Deal legislation that protects employees by conferring specific rights and benefits on them by virtue of their employment rather than their inclusion in a designated classification, such as ethnicity. Recall that the main components of the employment benefit system were in place by the end of the 1930s and are covered earlier in the book. To reiterate briefly, the first important development was in the area of workers' compensation legislation that displaced common law doctrine. With the legislative revolution of Franklin D. Roosevelt's New Deal, workers gained economic rights through Social Security, fair labor standards, and unemployment insurance. Congress continued to expand the New Deal programs and supplemented employment legislation with civil rights laws. ...
