Juvenile Offenders in Adult Courts
The modern basis behind trying juvenile offenders in adult court can be traced to the 1966 Supreme Court case Kent v. United States, which dictated the process to be followed in juvenile court by the judge to waive, transfer, or certify the matter to an adult criminal court. In other words, the charge(s) against the juvenile would be subject to criminal court procedures and sanctions should the juvenile judge decide in a judicial waiver hearing that the case was better suited for adult court.
