Due Process

Due process involves following established procedures in the enforcement of laws, rules, or policies and enforcing each in a fair and just manner rather than arbitrarily or capriciously. Due process serves to protect the rights of individuals facing adverse actions by the government, organization, or other entity.

In the United States, due process is based on principles from the U.S. Constitution and Bill of Rights that protects a person from being deprived of life, liberty, or property without due process of law. As applied to actions of federal, state, and local governmental entities, a person cannot be deprived of life, liberty, or property without appropriate legal procedures being followed and without the actions being legitimate and reasonable.
