  • The legal practice of affording an offender a term on probation in lieu of a conviction and subsequent punishment. Typically, if the offender completes probation without violating its terms, the charge is dismissed, and in effect, the person was never convicted. If someone violates the probation, a conviction is handed down, and the offender is sentenced accordingly.
