  • The mental capacity or mental ability of an individual person. In law, competency pertains to the mental capacity of a defendant. One who cannot understand the legal proceedings or assist in his or her own defense is deemed incompetent. In other instances, legal guardians are appointed for adults who are found incompetent to make decisions regarding their finances, health care, and so forth.
