  • An order issued by a judge in a criminal or civil proceeding. A bench warrant is a court order that authorizes law enforcement officers to take an individual into custody on sight. Usually, a bench warrant is issued for a person who has failed to make a required court appearance or has violated some other order or requirement of the court (e.g., paying child support). If on bail, the bail is generally revoked and the person held until trial as the defendant is deemed a flight risk, having already demonstrated untrustworthy behavior.
