  • A Latin term that translates as “guilty mind.” Mens rea is one of the necessary elements of proving an intentional criminal act. In criminal law, it is generally not enough to establish that a person has committed a bad act (the actus reus or crime); the prosecution must also demonstrate that the defendant had the requisite intent (or mens rea).
