Forcible Compulsion
The physical force or express or implied threat or intimidation used to compel a person, using fear of immediate death or physical injury to himself, herself, or another person or fear that he, she, or another person will immediately be kidnapped. Forcible compulsion of a child below 16 years of age may involve expressed or implied intimidation by another person 4 years older than the victim. The legal definition of consent often employed in sexual assault cases may require proof of forcible compulsion sufficient to overcome the resistance of the victim.
