Decision

Students have the First Amendment right to express themselves in public schools so long as they are not disruptive and do not impinge on the rights of others. As a result, students who wore black armbands to protest the Vietnam War should not have been suspended. Their symbolic protest was akin to the kind of “pure speech” that deserves a maximum amount of First Amendment protection.

Background

The United States’ growing involvement in the Vietnam War in the 1960s triggered nationwide protests, some of which became violent. The protests that triggered the landmark case of Tinker v. Des Moines Independent Community School District, however, were low-key.
